OK as of the 4th August 2012 you can now sell your property without having a building license already in place.
Article 22 of the new law has been suspended awaiting further review.
Sales contracts must include a clause stating whos responsibility it is to obtain the building permit by Dec 31st 2012
Its far from an ideal solution but at least it allows sales contracts to go through again.
Now that sellers are starting to realize how expensive and time consuming obtaining a building permit is prices are rising. Everyone wants to add €5k to €10k onto the sale price to cover the extra costs.
Most of the properties we sell are in the €25k to €75k price range so that is an increase of between almost 10% and 20%
Add to this most sellers misconception that their property "must" also increase by another 10% - 20% in price due to Croatia's pending EU membership
Thanks very much to the HR Gov for this enlightened piece of legislation at a time when prices should be getting lower we are looking at huge increases.

Hi, can someone please provide an update on "Legalizing" a house in Croatia. I have a home on Ciovo and need to legalize the property. I see on here that dec 31, 2012 is the deadline but someone in Croatia mentioned June , 2013 as the deadline date. The house is larger (approx. 400+m2)... Can anyone provide a ballpark idea of total cost I will face? Architect plans, Government fees...etc. Any help is greatly appreciated... Hvala unaprid

Radun, the law has been updated, and the deadline extended to 30th June 2013. Only an architect can give you some accurate figures of how much it will cost in your particular case. We are also in Ciovo (we have building permit but no Usage Permit) and have found a lot of very useful and updated information on this website, and these architects are very helpful. www.legalizacijagradnje.com/However they've told us that due to a massive increase in their workload, they now only deal with Legalization for properties in the Zagreb area (no longer in the Split/coastal area) so we are also looking at other professionals in Split. If we come up with any more upto-date information regarding Legalization, we will post it on the Forum

Thank you for your quick reply. I understand that the est. cost is around 5 euros per M2 for the architect but I cannot find exactly what fee will I pay after the plans are drawn up...

I have heard that the fee is different for houses which have more than 400 m2 vs houses under 400 m2. Can anyone confirm this? Thanks in advance

Yes over 400 sqM is in a different band, I think its to do with it being classed as non residential property, eg business premises. And yes the dealine is extended until end of June 2013 for people to apply. You must have an application in by this date. Our usual architects and surveyors are all reporting being overloaded (surprise surprise) and are now only working locally. We are finding the genuine "overall" total costs for a 100 - 150 sqM property to be in the region of 28,000kn Gov fees taxes and charges @ 10,000 - 15,000kn Architects @ 500 - 10,000kn Surveyors @ 3500 - 5000kn plus pdv www.privredni.hr/e-pvint/What a great way to introduce a new tax, underpinned by the fear of having your property demolished if you don't comply. So much for the gov promise that it would not be expensive. If all they wanted to do was legalise the real estate system in line with and as demanded by EU regs this could have been done tax free for existing properties. And surprise surprise you now have the banks offering new loan products to finance the cost of legalising property. Shame on this government, it is just blatant extortion.

I think my house is close to the 400 m2 mark. I am hopeful I come in under. I will have an architect do an initial visit on Saturday. I will be in panic mode if I cross the 400 m2... I am not sure what to expect. Some have told me to expect this total process to cost me around $10,000 while others have said it will be $20,000. This is a very difficult challenge to come up with that kind of money in under a yr. Had I known how this whole process was going to work out along with the local contractors over charging for poor workmanship I would have saved my money and just gone on regular resort vacations!
