when a parcel of land in croatia is classified as "gradevinsko" that is supposed to mean that it is legal to build on it. am i wrong?

what type of building is allowed? is it T1, T2, etc, is it residential, tourist, business etc?

two storey, 4 apartment . residential. someone i know purchased so called "gradevinsko " classified land, and now he isnt allowed to build on it because of an adjacent road that has many owners , some of which are now deceased. the problematic road leads to an entire illegally built neighbourhood and some legally built homes on the way. the problematic road is one of two roads intersecting infront of the parcel, the other road is govt owned. the road along with the illegal homes will not be destroyed by the croatian government, yet this "legal building land/ gradevinsko zemljiste" ...was sold and classified as such and now, this guy cannot build on it!!!!! he also paid an architect 7.000 euros for a plan. he checked with the local opcina prior to buying the land and now the local opcina refuse to give him a permit!!!!!! can he take this to some international court or amnesty international is it a breach of human rights when the local city council efs you around for thousands of hard earned euros??? "gradevinsko" what a joke. and just to add...the new gruntovnica internet site doesnt help , as the particular council , 10 kms south of split hasnt put its records on the site.

If he has his papers in order from before the building and permissions were granted, he's in the clear. It'd be best to nab the local deputy mayor, they usually have ways of sorting thigns out without paying cash.

the problem is a so called "javni put " that the local council dont consider a public street , but the investor has a paper stating that it is indeed nothing but a "javni- public put or street " . and what makes you think that anyone working in a council around the split area will help anyone ?? they are aallll as corrupt as it gets. and another thinbg thats weird about croatia is that the opcina want a plan of the building before they decide to give or not give you a building permit ,and that is very expensive. its like going to a bloody casino.

That is confusing, as a matter of interest I spoke with a colleague (lawyer) and asked him about such stuff this morning at a meeting. He said the same as me, go to the local opcina, they hold the overall key and if not then just march to your local sabor rep and explain to him that you've done nothing wrong and if they mess you around there'll be hell to pay (and as I know you're from Australia and living here years and years) you can throw in the overseas support too! Just a suggestion.

I don't get it. Does he need consent from the neighbours (dead or otherwise) to use the "road" before he can obtain planning permission? The fact is that as the land is classified as building land it must by law be provided with an access road. This however is a lengthy process especially is the surrounding land owners do not have permits for their houses. it may be the case that an urban development plan should be made for the whole neighbourhod - again, a lengthy process.

yeah. i dont get it eiother. all the houses have street numbers and infrustructure connected. one road is actually planned for widening in the new urban plan. by the way...the guy waited 2 years to make sure the land will come under "gradevinsko" in the new urban plan before purchasing it. and still...croatian scum beurocrats ex udba commys have really stuffed him up...big time. does anyone know of any organization i can contact , that may be able to help.. i rekon its seriously scummy behaviour by the local opcina , and that it needs to be condemned and brought to light. and irac thanks for your seuggestion...i will pass it on. i hope the sabor reps an understanding person ...

If the local Gov ont help tell them you have no choice but to go straight to Zagreb, get yourself a good lawyer and contact your embassy in Zagreb for support. I had to do this after I got badly screwed and it worked, you just need to stir t up a little.

ok. thanks for all your suggestions. its a shame that opcine , instead of giving motivation and incentives for investment...have reserved those "benefits" for a handful of corrupt builders connected with opcine, so that they can make a financial killing by not letting anyone build thereby raising prices of corrupt built apartment complexes. . bloody scum. when is this country going to change??
