Does anyone out there know much about the changes to the law concerning private non-nationals and letting regulations? Last I heard there was a change afoot meaning that you may not need to sign with a management company to let your property.....

Mate,
This is Croatia, who knows ... Thanks God they have enough laws and your whole life is nicely regulated, but the laws are usualy non-applicable to the citizens ....

The new law that comes into force in Feb 2009 means that a foreign citizen can buy property privately in Croatia quicker. Before it used to take ?? up to 4 years in some cases, if buying privately.
However you will still only be able to rent your property via a Croatian Company.
This will only change when Croatia is physically in Europe
The propety must be catagorised before you can rent regardless of the new law changes

Thanks upthevilla. I bought my house a few years ago now and yes it took 3 years for the permission. Does this mean that in effect nothing has changed on the rental front for non-nationals? Do you know where I can get more detail on this particular aspect of the law change?

Do you know if this law has been released/published yet? I checked the nn link but, without knowing the Croatian title of the law I was lost.

Not sure if I am confused or just annoyed as I logged on 3 sites to advertise without any problem ( no questions in relation to ownership or cro company) I wonder what are the risks involved if it is obvious that there are still owners renting without any concerns ?

Many web sites do not ask about your properties catagorisation status as they dont know or dont care.They just want your money
If they have an address that is NOT in Croatia then it would be difficult for the Cro authorities to prosecute them,.
However the law clearly states that a Cro company cannot advertise a property to rent that does NOt have the correct catagorisation . If the Cro compnay does so then they can face prosecution. Last year i took 10 properties off my books because they were not catergorised and as an agency i would be liable.
There are many owners who rent without any concerns, But when they get a 5,000 euro fine and there property sealed up, guests thrown out and up and coming court date then i guess they might be a bit more concerned.
Any good agency will not take the property and not take the risk, as for the likes of owners direct and the many others, well, when they get one of there clients kicked out of a 2,000 euro a week villa and the clients go back to them to complain and demand money back then they might do some research, but i highly doubt it and i`m sure they have enough small print to protect them.
The emphasis falls on the Owner of the apartmet to have catergorisation and to make sure the tourist tax is paid by the guests.If you dont then its your risk.

Waiting for entry into Europe, thats a whole seperate debate.
I have been here nearly 10 years and since i arrived it has been 2 years away, and the talk is now,that it is 2 years away. so who knows how long these 2 years will take.
Also arriving next year, for the last 10 years, has been the golf course, , and ryan air, well ryan air arrived after 6 years so it shows progress

Dear Upthevilla, as a new owner of small appartment I am very curious how it works and you being well informed can you please comment on the interpretation of existing law allowing up to 15 people to be non paying guests in your property within 15.06-15.09?Some comments say it applies to close family members ,but when I read this paragraph (I can read some croatian) I see it applies to any guests.regards,remik

Providing that the guests are NON paying then they are allowed to stay in the thoses dates It is stated as family and friends as these are the people that you would not be charging for. As for IF and HOW they check, they i doubt that they really do check, The main issue is that the property is NOT rented out and an income is NOT recieved. They still , however, have to pay the tourist tax

they will check in certain locations, this is a source of income for them so they are motivatead to catch you out. The notarised pre approved list should accompany the person along with their passport. Some seasonal staff wont have a clue but others will i wouldnt take the chance its not pleasant getting caught
