can anyone advise if there is any such thing as a standard house guarantee/warranty which should be issued on the completion of a new build house in croatia,similar to that offered in the uk. is such a guarantee enshrined in any of the legislation relation to the regulations pertaining to the building of new houses in croatia. i had previously heard that all new houses were protected legally by a 12 year guarantee, but have no idea if this is the case,and if it is, what the terms and conditions are. is there a standard template for any such guarantees and where might i find more information on this topic. any help would be appreciated

Warranty? What’s that? Maybe if you get your house built by an actual building company from start to finish, or purchase it already built, but most homes go up here by a host of different parties, cheap Bosnian labour and DIY enthusiasts.

They can give you any warranty you want to have, but because of a non-functioning justice system there is no way you can make claims. They will simply tell you to take them to court and you'll have fun for the next 20 years..........and they know that.
The only way to get around that is not to pay until you are 120 % satisfied about the quality they deliver or have delivered. The amount of money has to be such that they really want to have that part, i.o.w. if you owe them 1000 euro you will not get very far, but if you still have to pay 20,000 or 30,000 euro you have 'power to negotiate'.

Mambo is absolutely right.
The best way by far is to have your architect, surveyor or project manager arrange the completion clause in the contract to make sure that you hold back enough to ensure you grab their attention. Too high an amount and you will scare them off if it is unreasonable, it should be proportional to the quality of the build you are looking for and the total contract price.
A guarantee offered by a larger building company may have some validity if they are interested in protecting their reputation, so don't be afraid of approaching the bigger firms.
Also, do not advise building contractors about the completion clause until after they have submitted their offer or you will just see their prices rise in advance to cover this.

I actually had one of those building warranty things in the UK for a new house. It was worth nothing because the house was not built to last 100 years, just the length of the warranty. Just a personal gripe. The same is true of electrical goods now, they are manufactured to last the length of the warranty.

Their is a building guarantee for ten years . However, if you do not complain within the first year or two in some cases you will not be able to claim. I have successfully sued a builder for poor quality work. However, I had set up an association in my building claimed through the standard channels on behalf of the building and tenants and bobs your uncle. I also know of two other cases taking the same route through the building management company

one moe thing we used a surveyor to make an officual report he same procedure anyone would use in the Eu applies .

A warranty/guarantee is only worth the paper its written on if the person giving the warranty can and will actually do something. So often in Croatia, it falls at the hurdle of being able to do something and doesn't even get to whether they are willing to do something.( If you've got no money then you can't do anything even if you'd like to. ) I'd be looking for an insurance policy backed by a non-Croatian insurance company before I bought anything on the basis of a warranty. I do know a German company which was trying to get something like this off the ground... writing this post reminds me to email them to find out if they ever started building!
