Did she buy a new build and have to pay PDV on the purchase?
If the tax we are talking about really is RETT, then I don't understand why RETT has to paid before the property can be registered. Is that how things work on your island, yeslehec?

Hi Carol, it was a straight purchase of land, no buildings on it, every case I know of is that rett had to be paid before the property could be registered, anyway logically, they could sell it as their name wold be on the papers, and the government would have to whistle for there tax

its not like that in Kastela (or anywhere else we've sold property). For example,when I come to think about it, the people who were having the problems that prompted me to start this thread had the vlasnicki list in their names when we took the property on, but it wasn't until a couple of years later that the tax office issued that rett bill.
It makes sense to link the RETT payment to the land registry but I just haven't heard of the land registry doing this before.
As the agent, did you just put a plombe on the land whilst awaiting the RETT bill/ payment? Is that how it worked?
If she sells the land without paying the RETT, it will cause enormous problems for her buyer.

hi carol, i understand its common practice for rett to be paid before registration is accepted in land registry, especially in Dubrovnik and Rijeka
It is very interesting to know exactly what tax/fee she paid... Maybe she had a poor translator, as a tax of 5% is hardly unnoticeable and it could be she just paid notary fees... Only the parties involved can shed light on this

a plombe is the note that can appear in the bottom section of a vlasnicki list noting that someone other than the registered owner has an interest in the property.
Two examples of where you might see a plombe would be either when a bank who had lent money against the property or a person who has given the land registry their purchase contract but who hasn't yet got their name entered into the register as the owner.
A plombe would stop the named owner selling the property to someone else (or at least it should if the next buyer did the minimum possible checks on the property prior to purchase).
I think plombe is the Croatian word but I don't think there is an English equivalent.... maybe something like "block" or "weight"??

SO: What I paid was not a sales tax or RETT - what I thought was a sales tax was actually agency fees and the fee for the surveyor. I'm told I must pay the RETT before the land is actually registered in my name, which makes sense, but I'm waiting to hear back about what I owe. In the meantime, since I am not in Croatia, I fear the government will take back what I purchased in full with no bank loan.

tinica - why would you fear that?! You will be fine as long as you pay your RETT bill.
Make sure that you will receive the RETT bill when it is sent out by the tax office and you'll be fine.

I think the lawyer has already received the bill, but I haven't seen it nor do I have any idea how much it is. I suppose I fear getting the bill!

tinica - I don't think you should have bought property at all if you can't bring yourself to do this. Go and ask the lawyer for the bill today. You only have a few weeks to pay it after it is issued. It won't go away or get less if you ignore it but it will start to go up if you miss the payment deadline. you owe it to yourself to do this.
