Hi all .. I havent escaped completely unscathed from my Croatia Property Purchase..
The Estate Agent was given around 2000 Euros payment (dont ask me why the wife handed it over) at the point of pre-contract.
The Estate Agent has told us (naturally - after finding out we had been paid out by the company) that according to Croatian law he cannot refund this money. The agent says he must be paid regardless of whether the sale completes. He even said that in fact we may even owe him money..
He said I am welcome to check my facts but this is the law. However he also says that he will offer a discount on his fees if we come back to look again 1.5% instead of the normal 3%. We have evidence of payment in the form of a letter he typed up signed by him and us stating the fees paid.
Can anyone clarify if what he says is true. Is this how it works in Croatia. The agent gets paid regardless of whether the sale completes? Surely this cant be right. Ive also emailed a croatian lawyer to confirm this.

it all depends upon your contract with him. Some agents ask for payment after the final contract has been signed, others at the pre-contract stage and others in stages 50% at the pre-contract and 50% at the end. Some even take fees at the point your offer is accepted.
When it comes to refunds, some refund if the sale fails, others do not.
So check your contract with the agent and whatever you signed up to is what you should expect. He did do some work for you didn't he? At least helping you get your double deposit??

Yes , already paid all our fees to estate agency on signing. Morally of course your sale was achieved by estate agent and you wanted it - seller backed out so should he not be liable for estate agent's fees? Morally yes but I'd be surprised if any contract would go that far....something to keep in mind for future buyers??? In Croatia is it not practice for estate agent to collect a % from both buyer and seller? So is are they trying to get full % from you?

sometimes there are 2 or even 3 agents involved. At the moment we have one with 4!

I am not trying to be negative but I think the next time you go into contract with anyone. Have all the contracts done in English. I think a majority of your problems are because you have to have your wife translate everything and that makes things very difficult. I don't think you would have signed that contract if you had known this...eh? In California.... agents do not get paid if there is no sale. They get paid at the end of a transaction. The way it should be. Escrow holds all money so all sides get paid at one time. I am not to sure what is customary in Croatia. If anyone would know, it would be Carol.
