Darcy, even signed and sealed Croatian contracts are ignored as culprits don't fear courts.
How often have people heard "I'm going to take you to court" or "I'm going to call the police" used personally or specifically in relation to foreigners. Locals won't ever say such stupid things unless there has been a murder or major falling out. However the threat is constantly here for foreigners.
I got one from a taxi driver who wanted €100 to take us from just behind Klis to the airport - when we got a lift to Solin and then he arrived, threatening to call the police, I handed him my mobile and said - "The emergency number is speed dial 3" - he suddenly backed down. It's a sad side of primitivism that pervades at times here.

Ha, ha, I know all Croatians are on court, most of my Croatian neighbours are - incorrectly connected sewage, retaining walls, inheritance and similar disputes. There is a Croatian joke that says: "When I win Lotto, I am going to take you all to the court". Croatians like to go to court and they are incapable of solving problems without the court. That is why everything is non-functioning.

That is why everything is non-functioning. so true, sadly. Very common to take members of your own family to court, based on lies and bribes. Suppose it makes them feel important or something.

Well looks like the agent isnt going to payout. The deadline was today and he has said he will go to court to fight it.
Beware when buying in Krk.... I suggest you avoid this agency!

The agent or the seller ?
If the seller doesn't pay out go to a notary, with the contract. Show them where it says they have to pay twice if they bail out, then show the piece of paper in which they tell you the deal is off and you should be able to put a claim to his bank account immediately.
That is one of the good things which have changed over the last few years. Now you don't have to go to court anymore if someone does not pay. You can immediately go after the money if you can prove the money is yours.
That should be a nice surprise for the seller I think.

Krk, I can only say there is nothing in CRO law (up to my knowledge) that will allow the agent to keep the refund. RE agencies are not regulated in Croatia, so everything is between you and the agency. Read your contract with the agency one more time and make the decision. Let me know if I can help.

Mambo has it right, there's more than one way to skin a cat and this "I'm going to take you too court" even when the idiot threatening is totally in the wrong is hilarious. However, the best way is to call a bluff. Nod, smile, say nothing, then do (in your case as Mambo says) or land them with a court order. It's very interesting how quickly they shape up.

Its the estate agent now not the seller thats holding money. Ive already got double the deposit back from the seller.
Can I use the Notary to get money off the Estate Agent? The one thing I dont have is a contract with the estate agent (live and learn I suppose). I do however have a signed document signed by us and the estate agent with the amount of Kuna we paid him for his services in buying an apartment (that didnt actually happen). Keeping almost 3% of the apartment cost for doing nothing isnt acceptable in my books!..
Perhaps a demand letter from a lawyer if I cant use the Notary?

I am not aware what mambo has on his mind, bit it is worth trying. Go and see how notary public can help.
I see your case as a dispute - you paid for something and ypu did not receive a service. Receipt might be enough if you can make your case. In your case, commerical court is responsible ("trgovacki sud").

Krk Island. If you are still a Kvarner buyer you should contact Mirsada at Qtim in Rijeka. She also has a great lawyer next door who has an official court translator as his no 2. Mirsada is one of only two honest agents I have found in this part of the world. She is not so good if you are selling as she lacks the killer instinct but if you are a buyer or want property management she is a gem.
